Privacy

ShopSentric, Inc. ("ShopSentric"), owner and provider of ShopSentric services, values your privacy. ShopSentric (“we” or “us”) provides ShopSentric mobile and online messaging technologies that enable SMS and digital communication between our Business Clients and Shoppers through text, voice, and other methods.  Our systems allow Shoppers to contact Business Clients anonymously (“Service”). This Privacy Policy explains what personal data we collect from you, how we use it, and options you have with respect to it.

 

Unless further definition is provided in a specific provision, “you” applies here to a user who is a Business Client of ShopSentric or to a user who is a Shopper.  A Business Client is a person or company who subscribes to the Service.  A Shopper is a person who initiates communication with a Business Client through the Service via SMS, MMS, or other text message type. (collectively referred to as “text message” throughout).  
 
Who does this Privacy Policy apply to?

This Privacy Policy applies if you visit the corporate websites of ShopSentric, or if you use the Service (collectively, the “Service”) as a Business Client or a Shopper.

Note that under the EU General Data Protection Regulation (GDPR), EU residents have the following rights:

Accordingly, EU and Swiss individuals have the right to access personal data about them, and to limit use and disclosure of their personal data.  Options for doing so by EU, Swiss, and other individuals are explained in this Privacy Policy.

What information do we collect from you?

​

The Service provides Shoppers and Business Clients with the ability to communicate via text message and phone without the Shopper disclosing their personal information (such as name, e-mail address or telephone number). If you contact a Business Client through the Service via an anonymous text message, the Business Client will have the ability to respond to that message and communicate with you by text message or phone without having your mobile number.

 
If you are a Shopper or a Business Client communicating via text messaging or phone using the Service, we collect:

  • Telephone number;

  • User Content in messaging transcripts, and

  • Automatic information, such as phone number, IP address, operating system and type of device used.

If you are a Business Client, we may additionally collect:

  • Business and personal information, such as your name, the business name, contact information, payment information, and other information to provide you with requested materials and information required to facilitate your use of the Service;

  • Financial information for processing payments for your subscription to the Services;

  • Surveys, transcripts and recordings of your communications with us; and

  • Automatic information, such as Web browser and usage information, including IP address, browser types, page view tallies, time spent on each page, page browsing information, operating system and type of device used.

 

How does ShopSentric collect information from you?

 

If you are a Business Client, we collect information via:

  • Your input via email, facsimile, phone, or other means;

  • Using cookies, web beacons, and other similar devices; and

  • Analysis of information in transcripts of text messages transmitted via the Service.

 

If you are a Shopper, we collect information via:

  • Using cookies, web beacons, and other similar devices; and

  • Analysis of information in transcripts of text messages communicated via the Service.

 

Giving Consent and Providing Information During Communication

 

As a Shopper, if you send an advertised keyword to an advertised shortcode to provide consent to receive text messages and phone calls from the associated Business Client, then that Business Client will have access to any information you choose to share during those communications.

 
If you, as a Shopper, give consent to receive text messages and phone calls from a Business Client, you’ll receive messages and phone calls from the Business Client. Both you and the Business Client may end such communication at any time by texting “STOP”. If, in the course of a text message or voice conversation, you supply to the Business Client your email address and/or telephone number, you consent to receive e-mail communications to such e-mail address and calls and texts at that telephone number, whether manually or automatically generated.  You are under no obligation to provide your name or contact information over the course of such text message or phone communication.


If You, as a Shopper, choose to engage in any communication with a Business Client or ShopSentric, it is up to you to decide what, if any, information to provide during such text message or voice communication.  Depending on your request, it may not be possible for us or the Business Client to address all of your questions without further information from you.  Nevertheless, if you do not wish to provide certain information, then you should not do so. 

 

If You, as an Business Client, choose to engage in any communication with a Shopper or ShopSentric, it is up to you to decide what, if any, information to provide during such text message or voice communication.  Depending on your request, it may not be possible for us or the Shopper to address all of your questions without further information from you.  Nevertheless, if you do not wish to provide certain information, then you should not do so. 

 

Who has access to my data?

As a Shopper, if you send a keyword to an advertised short code to provide consent for text messaging and voice communication through the Service, then the associated Business Client and ShopSentric will have access to any information you choose to share in communications.  Your phone number will not be shared by ShopSentric with the Business Client except as provided in this Privacy Policy or with your permission.

 

As a Business Client, when you initiate a Service Account with us by executing a Service Agreement, we at ShopSentric can access your account information and text message communications made through the Service.

 

Third party service providers that work with ShopSentric may have access to your data as further described under the header “With whom, and for what purposes, does ShopSentric share information collected?” below.

 

How does ShopSentric use the information it collects about me?

 

We use the information we collect to provide and improve our services. We process your information if you have given your consent; if it’s necessary to perform a contract with you or to take steps at your request prior to entering into a contract; if it’s necessary to comply with legal obligations; or if it’s necessary for us or a third party to pursue a legitimate interest.

 

ShopSentric may retain your information for a period of time consistent with the original purpose of collection.  For example, ShopSentric may store your phone number in association with data relating to a text message communication transcript.  

 

ShopSentric may use financial information to process payment for any purchases made for our Service (e.g., payments in accordance with an executed Service Agreement), enroll you in a discount, rebate, and other programs in which you elect to participate, to protect against or identify possible fraudulent transactions, and otherwise as needed to manage our business.

 

We may also retain your information during the period of time needed for ShopSentric to pursue our legitimate business interests, conduct audits, comply with our legal obligations, resolve disputes, and enforce our agreements.

 

ShopSentric may aggregate information so that it is not personally identifiable.  We may use non-personal information we collect under any of the above circumstances. We may combine non-personal information we collect with additional non-personal information collected from other sources. We may use aggregated non-personally identifying information for business analysis, trends, and for any other lawful purpose.

 

What identification technologies and providers does ShopSentric use? 

 

ShopSentric uses the following identification technologies:

 

1. Cookies.  A cookie is a small piece of information sent by a web site that is stored on your hard disk by your computer’s browser. The Service uses two kinds of cookies: session cookies and persistent cookies. Session cookies exist only for as long as your browser remains open. We use session cookies, for example, to analyze browsing behavior. Persistent cookies last from visit to visit; they do not go away when you exit your browser. At ShopSentric, we may use persistent cookies to give you a more personalized user experience and to help you navigate our Service more efficiently. For example, we may use persistent cookies to analyze browsing behavior? 

 

2. Beacons (also known as clear gifs, pixel tags, or pixels). These are small blocks of code installed on (or called by) a webpage or the Service, which can retrieve particular data about your device and browser, including device type, browser type, time of visit to the website, IP address, and other similar information.

 

Third-party service providers
ShopSentric may work with, and authorize, third-party service providers to insert cookies, beacons or similar technologies on our Services with our permission.  These technologies assist us to compile metrics and analytics to help improve our Services.  Third-party cookies and technologies are covered by the privacy policy of each of such third party services.  

 

Declining Cookies
Managing cookies preferences differs from browser to browser so please refer to your browser for further information. If you would like to disable cookies from our Service, please use the help function in your web browser to restrict cookies from our Service. If your browser is set to decline cookies, portions of our Services may not be available or will not work as effectively for you. 

 

With whom, and for what purposes, does ShopSentric share information collected?

 

1.  In general.  ShopSentric does not sell, trade or rent personally-identifying information provided by you in any communication transcript or any other purpose, except as provided in this Privacy Policy or with your permission. ShopSentric does not disclose the contents of communication transcripts, other than to service providers performing services on behalf of ShopSentric, other than as provided in this Privacy Policy or with your permission.

2.  Personally-identifying information.  ShopSentric may share personally-identifying information for the following purposes.

 

a. Service providers 
We may share your information with third party service providers with whom we have relationship solely for the purpose of delivering the Services. For example, we may share your personal information with companies that perform services for us, such as data storage, analyzing customer data, providing marketing and promotional assistance, investigating fraudulent activity, conducting customer surveys, credit card processing, and providing customer service. These service providers may have access to personal information needed to perform their functions but are not permitted to share or use such information for any other purposes. These third parties may access, process or store personal data in the course of providing their services.

b. For legal reasons 

  • In response to a subpoena or similar investigative demand, a court order, or a request for cooperation from law enforcement or other government agency; to establish or exercise our legal rights; to defend against legal claims; or as otherwise required by law. In such cases, we may raise or waive any legal objection or right available to us.

  • When we believe disclosure is appropriate in connection with efforts to investigate, prevent, or take other action regarding illegal activity, suspected fraud or other wrongdoing; to protect and defend the rights, property or safety of our company, our users, our employees, or others; to comply with applicable law or cooperate with law enforcement; or to enforce our Service’s Terms of Use, an Service Account Agreement, or other agreements or policies.

  • In connection with a substantial corporate transaction, such as the sale of our business, a divestiture, merger, consolidation, or asset sale, or in the unlikely event of bankruptcy.

  • Is otherwise necessary or appropriate to protect our rights or property or the rights or property of any person or entity.

3.  Aggregated and non-personally-identifying information: We may share non-personal information we collect under any of the above circumstances. We may also share it with third parties to develop and deliver targeted advertising through our Service and on web sites of third parties, and to analyze and report on advertising you see. We also may share aggregated, non-personal information with third parties, including advisors, advertisers and investors, for the purpose of conducting general business analysis or for any other lawful purpose.

 

How can I receive a copy of, or request to limit use/disclosure of, deletion of, and correction of my information?

 

If you would like a copy of, to limit use and/or disclosure of, deletion of, or correction of, your personally-identifying information, contact us with your telephone number.  If the request is directed to us, we will handle your request.  If the request is directed to a Business Client, we will forward your request to the Client, and will provide them with reasonable support, if necessary, in replying to your request.

 

As a Business Client, if you cancel your account, as per your Service Agreement, we may still retain certain information associated with your account for analytical purposes and recordkeeping integrity, as well as to prevent fraud, collect any fees owed, enforce our Terms of Use or the Service Agreement, take actions we deem necessary to protect the integrity of our Service or our users, or take other actions otherwise permitted by law. In addition, if certain information has already been provided to third parties as described in this Privacy Policy, retention of that information will be subject to those third parties’ policies.

 

How does ShopSentric keep my information secure?

Your security is a priority at ShopSentric. We take appropriate security measures (including physical, electronic and procedural measures) to help safeguard your personal information from unauthorized access and disclosure. Secure Socket Layering (SSL) technology is used to encrypt your personal and credit or debit card information, while it is transmitted over the Internet from your computer.  SSL is an industry standard technology for secure online transactions. To protect your information once we receive it, we place it on systems behind secure firewalls, which are communication-management computers designed to keep information safe and inaccessible to other Internet users. your browser doesn’t accept the SSL technology, transactions will not be permitted. To confirm that your connection is secure, look for the letters "https" (rather than "http") located in the URL address window at the top of your browser to indicate that you are using a secure browser.
 
We want you to feel confident using our Service to transact business. However, no system can be completely secure. Therefore, although we take steps to secure your information, we do not promise, and you should not expect, that your personal information, searches, or other communications will always remain secure. You should also take care with how you handle and disclose your personal information and should avoid sending personal information through insecure email. Opting-Out of Further Communication

If you wish to withdraw consent to receive text message and voice communication from a Business Client or Shopper, at any time, you may opt out by sending “STOP” to the phone number, associated with the Business Client or Shopper, through which you have been communicating.

 

Transfer of Data Abroad

​

If you are using our Service from a country other than the country in which our servers are located, your communications with us may result in the transfer of information across international boundaries.  By using our Service, you consent to such transfers.

 

Your California Privacy Rights


Under California law, a California resident with whom we have an established relationship has the right to request certain information with respect to the types of personal information we have shared with third parties for their direct marketing purposes, and the identities of those third parties, within the immediately preceding calendar year, subject to certain exceptions. Minors

The Service is not directed to individuals under 18.  If you are under the age of 18, you may only use the Service or provide any personally-identifying information to us or through the Service with consent of a parent or legal guardian.  If you use the Service, you represent that you are at least 18 years old.  Individuals under the age of 18 are prohibited from using the services.  ShopSentric does not knowingly collect, or allow collection of personal information, from individuals below the age of 18.  If you are a parent or legal guardian of an individual under 18 and believe your child has provided personally-identifying information to ShopSentric or to a Business Client through the Service, or if you are a California resident under the age of 18 and wish to remove content you have made publicly available, please contact us at customercare@ShopSentric.com to request to exercise your applicable access, rectification, cancellation, and/or objection rights.  ShopSentric reserves the right to immediately delete the information, or terminate the service account of, of any individual, to the extent permitted by law, who it learns or believes is under the age of 18.

We may update this privacy policy periodically.  Accordingly, we recommend that you visit this page to review again from time to time.  After an update to this Privacy Policy, your continued use of our Service constitutes your consent to the new term of the Privacy Policy to the fullest extent permitted by law. 

 

We do not control, and are not responsible for, the privacy practices of any of our Business Clients or any other third party.  We encourage you to review the privacy policies of each third party.
